Terms of Service

1. About us and these terms

JEM MEDIA LTD is registered in England and Wales (company number 16287434), with its registered office at 195-197, Suite Ra01 Wood Street, London, United Kingdom, E17 3NU.

In these terms:

• Services means jemedia.xyz, JEMEDIA Accounts and the other services we run, such as Verified Handles.
• JEMEDIA account means the account you create with JEMEDIA Accounts at auth.jemedia.xyz.
• Connected service means a website or app that lets you sign in with your JEMEDIA account.
• Organisation means a group on JEMEDIA Accounts, such as the users of a connected service, that has its own administrators.

By creating an account or using the Services, you agree to these terms.

2. Who can use the Services

You must be at least 13 to create a JEMEDIA account. If you are under 18, you confirm that a parent or guardian has agreed to these terms. If you use the Services for an organisation, you confirm you have authority to accept these terms for it.

3. Your JEMEDIA account

• Give accurate details and keep them up to date.
• Each account is for one person. Do not share it.
• Keep your password, passkeys, recovery codes and sign-in links secure. You are responsible for activity on your account unless it happens because of our failure.
• If you think someone else has access to your account, change your password, sign out everywhere at auth.jemedia.xyz/account, and tell us at support@jemedia.xyz.
• If you sign in with Google, Google’s own terms also apply to your Google Account.

4. Connected services and organisations

Each connected service has its own terms and privacy policy, which apply when you use it. Before your account details are shared with a connected service, we ask you to approve it. We are responsible for JEMEDIA Accounts, but not for connected services we do not run.

If you join an organisation, its administrators can manage your membership of that organisation, including removing you. They cannot stop you deleting your JEMEDIA account. If an organisation requires approval for deletions, your request is completed automatically within 30 days.

5. Acceptable use

You must not:

• break the law, or use the Services to harm others;
• access or try to access accounts or data that are not yours;
• get around or test our security, rate limits or CAPTCHA, except as allowed below;
• create accounts automatically or in bulk, or try password lists against accounts;
• impersonate anyone, or misrepresent who you are;
• scrape the Services, or put an unreasonable load on them;
• upload malware, or interfere with the Services or other people’s use of them.

We welcome good-faith security research. Report vulnerabilities to security@jemedia.xyz, do not access other people’s data, and give us reasonable time to fix the problem before you disclose it.

6. Service-specific terms

Some Services have extra terms, such as the Verified Handles Terms of Service. They add to these terms. If they conflict, the service-specific terms apply to that service.

7. Fees

The Services are currently free. If we introduce charges, we will tell you at least 30 days in advance, and you will not pay anything unless you agree to.

8. Intellectual property

We, or our licensors, own the Services, including their software, design and branding. These terms give you permission to use the Services, not ownership of them. You keep any rights you have in content you provide. You give us permission to use that content as needed to run the Services. Licences for content in a particular Service, such as Verified Handles, are set out in its own terms.

9. Availability and changes to the Services

We work to keep the Services available and secure, but we do not guarantee they will always be available or error-free. You can see their current status at status.jemedia.xyz. We may change, suspend or stop a Service. If a change significantly affects you, we will give you reasonable notice where we can, and the chance to download your data first.

10. Suspending and closing accounts

You can stop using the Services and delete your account at any time.

We may suspend or close your account if you seriously or repeatedly break these terms, if we must for legal reasons, or to protect other users or the Services. Where we reasonably can, we will tell you why first and give you a chance to fix the problem.

When your account is closed, your right to use the Services ends. Sections that by their nature should continue, such as liability and governing law, still apply.

11. Our responsibility to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude.

If you are a consumer, you have legal rights in relation to services that are not provided with reasonable care and skill, and nothing in these terms affects them. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. Because the Services are free and provided for personal use, we are not liable to you for any loss of profit, business or business opportunity.

If you use the Services for a business, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or data. You will compensate us for reasonable losses and costs arising from claims by others caused by your breach of these terms.

12. Changes to these terms

We may update these terms, for example to reflect changes to the Services or the law. If a change is material, we will tell you by email at least 30 days before it takes effect, and may also ask you to accept it when you next sign in, unless the change is needed sooner for legal or security reasons. If you do not agree, you can delete your account before the change takes effect. Previous versions are listed in the version history below.

13. Governing law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and the mandatory consumer laws of your home nation still apply. Please contact us first so we can try to resolve any problem.

14. General

• These terms, with any service-specific terms and our Privacy Policy, are the whole agreement between you and us about the Services.
• If a court finds part of these terms unenforceable, the rest still applies.
• We may transfer our rights and obligations under these terms to another organisation that takes over the Services. We will tell you if this happens, and it will not reduce your rights. You may not transfer your account to anyone else.
• No one else has rights under these terms, including under the Contracts (Rights of Third Parties) Act 1999.
• If we do not enforce our rights straight away, we can still enforce them later.
• We will send you notices by email to the address on your account, or show them when you sign in.
